1. Acceptance of these Terms
These Terms of Service (the “Terms”) govern access to and use of mcpdata.io, its MCP endpoints, API, and any related service (together, the “Service”), operated by MCP Data. By accessing the website, connecting an agent to an MCP endpoint, or purchasing credits, you accept these Terms in full.
If you do not agree with any part of these Terms, you must not access or use the Service.
We may update these Terms at any time. Continued use of the Service after a change constitutes acceptance of the updated Terms.
2. Description of the Service
MCP Data exposes official public data from Latin American countries through MCP-native servers (geocoding, territorial intelligence, and identity/company verification), consumed on a pay-per-successful-call basis using prepaid credits.
The Service is provided as software-as-a-service (SaaS): you access hosted functionality via API/MCP endpoints. No source code, license, or ownership rights over the platform are transferred to you.
We may modify, expand, or discontinue tools, endpoints, or countries covered by the Service at any time, in order to maintain, improve, or update the platform.
3. Accounts, credits & acceptable use
Access to paid tiers requires loading credits under the plan structure published on our Pricing page. One credit is charged per successful call; unsuccessful lookups (no match found) are not charged. Credits do not expire and are not subject to automatic recurring billing.
The free tier (2,000 credits) requires a valid corporate email address; personal email domains are not eligible.
You agree not to:
- Access or attempt to access data, accounts, or systems without authorization or by circumventing security controls.
- Run vulnerability scans, penetration tests, or exploitation attempts against the Service without our prior written authorization.
- Interfere with, overload, or disrupt the Service, its servers, or the networks connected to it.
- Introduce malware, malicious scripts, or any code intended to damage or alter the Service or its data.
- Resell, redistribute, or republish raw registry data obtained through the Service as a standalone data product without our written consent.
- Use the Service for any purpose that violates applicable law in the jurisdiction where you operate.
Breach of any of these obligations may result in immediate suspension of access, without prejudice to any other legal remedy available to us.
4. Service provided “as is”; no warranty
MCP Data provides data aggregated from official public sources as-is and as-available, without warranties of any kind, whether express or implied, including — without limitation — warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.
Data accuracy, completeness, and timeliness are the responsibility of the original official source, not of MCP Data. We make reasonable efforts to maintain accuracy and uptime but do not guarantee an error-free or uninterrupted service.
All use of the Service, and any decision made based on the information it returns, is at your sole risk and responsibility.
5. Refunds
Unused credit balances may be refunded upon request, provided the request is made within twelve (12) months of the original purchase. To request a refund, contact contact@mcpdata.io indicating the account, purchase reference, and remaining balance.
Credits already consumed (i.e., corresponding to successful calls already billed) are non-refundable. Refunds do not include compensation for indirect losses, lost profits, or any amount beyond the unused credit balance actually paid.
6. Limitation of liability
To the maximum extent permitted by law, MCP Data will not be liable for any direct, indirect, incidental, punitive, special, or consequential damages — including lost profits, lost data, lost business opportunities, or moral damages — arising from the use of, or inability to use, the Service, or from decisions made based on the information it provides.
Information returned by the Service is an additional input for your own decision-making process; you remain solely responsible for how it is used within your product or operation.
7. Data sources & intellectual property
All data made available through the Service originates from official public registries in each covered country, obtained and processed in compliance with the data protection laws applicable in each jurisdiction. See our Privacy Policy for details on data handling.
The website, its design, code, trademarks, and documentation are the property of MCP Data or its licensors and are protected under applicable intellectual property law. Reproduction, distribution, or public communication without express authorization is prohibited.
8. Third-party links
The Service may include links to third-party sites, which we do not control and for which we assume no responsibility regarding content, services, or privacy practices.
9. Infrastructure & security
The Service runs on infrastructure provided by DigitalOcean and Cloudflare, both certified under SOC 2 Type II, ISO/IEC 27001, and PCI DSS. Certification details and public compliance reports for each provider are referenced in the footer of this site.
10. Changes to the Service and these Terms
We reserve the right to modify, suspend, or discontinue the Service, in whole or in part, and to update these Terms, at any time and without prior notice.
11. Governing law & jurisdiction
These Terms are governed by the laws of Argentina, including Ley 25.326 on the Protection of Personal Data. Any dispute arising from these Terms will be submitted to the competent courts of Buenos Aires, Argentina.
